iWave warrants that all goods delivered will be free from defects in workmanship, material, and manufacturing; and Comply with the requirements of the purchase order, including any drawings or specifications incorporated. Except as set forth in writing in the Limited Warranty, iWave makes no other representations or warranties, either express or implied, including without limitation any implied warranty of merchantability or fitness for a particular purpose.
iWave will never be responsible for any form of consequential or incidental damages to the end user. In addition, iWave disclaims any liability for any loss, harm, or expenditure resulting from using the product or from any other source, whether direct or indirect. Repairing the product will be your only option if you have a claim against iWave, regardless of whether it's based on a contract, warranty, tort, or another legal theory. For this reason, iWave reserves the right, at its discretion, to inspect Products and/or Services at the Customer's or iWave's premises.

Exclusions from Warranty

iWave does not provide warranty for defects caused by:

• Handling errors, intervention, or modification of the products by the customer or an unauthorized third party.
• Incorrect installation by the customer or a third party acting on the customer’s behalf.
• Compatibility and functioning with other products, unless expressly warranted.
• Defects caused by outside influences.
• Fitness of the products for any particular purpose.
• Third-party products for which the respective manufacturer is responsible.
• Services that have not been performed in accordance with the instructions.
• Accessories such as batteries, antennas, adaptors and cables

Limitation of Liability

iWave shall not be held answerable for any consequential, incidental, special, or exemplary damages suffered through the consumer and/or any stop consumer associated with or bobbing up out of this settlement, the transactions pondered hereby, and/or the use or incapability to apply the goods, along with integration of the goods with gadget now no longer furnished through iWave, lack of goodwill or profits, or from every other reason whatsoever, even supposing iWave has been suggested of the opportunity of such damages. In no occasion shall iWave`s legal responsibility for any reason of motion referring to this settlement exceed the overall quantities obtained through iWave from the consumer for the service or product this is the difficulty of such declare or dispute in the final 12 months.

iWave agrees with the buyer that any provision of this Agreement that limits liability, disallows warranties or excludes damages should be severable from any other provision of this Agreement. These provisions are separate elements of the risk assignment between the Parties and should be enforced independently.

Both Parties agree that the Pricing of iWave Products reflects the Risk Allocation, Warranty and Limitation of Liability Provisions outlined in this Agreement. The iWave Products sold under this Agreement are not intended or intended to be used in Medical Life-Saving or Life-Sustaining Applications where the Failure of an iWave Product Could Result in Personal Injury or Death. If the buyer purchases or uses iWave Products for any such Unintended Use, the buyer undertakes to indemnify iWave and its Directors, Officers, Subcontractors, and Affiliates, and to hold iWave liable for any Claims, Costs, Damages, Expenses, and Attorney Fees, directly or indirectly, arising out of any Product Liability, Personal Injury, or Death, unless iWave agrees to the contrary in writing.This indemnification applies even if the claim alleges negligence on the part of iWave or its subcontractors regarding the design or manufacture of the iWave product or any of its parts.
